Until the end of the 14th century there was at common law no crime of “heresy” as such. The courts did not try doctrinal questions (e.g., transubstantiation, authority of the Church). Judges and juries had no competence to determine heretical belief. So if someone was accused of heresy, a common law court would not normally hear that charge at all.

The Church courts could investigate suspect doctrine, require abjuration, impose penances, or excommunicate.
But they could not impose death or corporal punishment under English law. So they could declare someone a heretic, but not execute them.

However, contempt of ecclesiastical authority (akin to contempt of court) could sometimes lead to secular enforcement once excommunication had political/legal consequences. Excommunication could trigger loss of legal rights (e.g., inability to sue), which had practical effects. In extreme cases, perceived threats to order might overlap with offences like sedition or treason, but that was not “heresy” as such.

Before the enactment by Parliament of the statute De haeretico comburendo 1401 there was no jurisdiction to coerce baptised persons into conformity with the Church save where there was an element of sedition or treason.
